The applicant is apprehending arrest in C.R. No. I-47 of 2019 registered with Dahanu Police Station for offences punishable under Section 409, 420, 120 (b) of Indian Penal Code. 2.

The contention of the applicant is that he was working as a junior clerk. During the course of investigation the applicant was called for interrogation. He produced the documents. Apprehending arrest the applicant preferred application for anticipatory bail before the Sessions Court where in it was observed that the applicant was called by notice to record his statement but he is not showed as an accused in this crime. However, application was rejected on the ground that he will not cooperate with the investigation.

Learned APP on instructions submits that till today the applicant is not impleaded as an accused. It is further submitted that the applicant be directed to appear for recording his statement. The applicant shall appear before Investigating Officer on 28th January, 2020. In the event the investigating machinery intends to arrest the applicant, he shall be given 72 hours notice (excluding public holidays) in writing prior to his arrest. Application stands disposed of accordingly.
