Learned counsel for the Appellant has tendered an application seeking withdrawal of the aforesaid First Appeal. The same is taken on record.

Learned counsel for the Appellant states that the First Appeal was 1/3

filed challenging the impugned judgment and order dated 27th August 2019 passed by the learned VIIIth Joint Civil Judge, Senior Division, Sangli below Exhibit-46 in Special Civil Suit No.250 of 2014. He submits that pending admission of the aforesaid First Appeal, the parties (i.e. Appellant and the Respondents) have mutually arrived at a settlement by entering into an MOU dated 11th March 2022.

Learned counsel for the respondents does not dispute the same. 4.

It appears that parties have agreed that the Appellants will withdraw the aforesaid First Appeal pending before this Court, as per the MOU dated 11th March 2022. The said MOU is annexed to the application tendered by the learned counsel for the Appellant/Applicant today. 5.

Accordingly, having regard to the settlement arrived at between the parties, by way of an MOU dated 11th March 2022 which is annexed to the application, the First Appeal No.40 of 2020 alongwith Interim Application No.681 of 2020 stands disposed of as withdrawn. 2/3

Needless to state, that the Registry to refund the Court fees, as per Rules.
