1) By an order dated 18.1.2017 the applicant was granted interim relief. It is the allegation of the prosecution that son of the applicant Nainesh has mis-represented that he will give flats in MHADA building and accepted certain amounts from the first informant and other witnesses. It is the prosecution case that other son of the applicant namely Akshay is also involved in the present crime. The allegations against the applicant is that one cheque dated 30.5.2015 issued by the first informant in his own name "Self" has been encahsed by the applicant. The record of investigation reveals that it is the son of the applicant Nainesh who is the main perpetrator of the crime and it further appears that the applicant has no major role to play in the present crime. In view thereof, the applicant has made out a case for his release on bail.

a) The interim relief granted by this Court by an order dated 18.1.2017 is hereby confirmed however, the condition to attend the Investigation Officer /Police Station is hereby waived.
