At the request of the learned Counsel Petitioners, leave to add the concerned Scrutiny Committees as parties, is granted. Amendment shall be carried out forthwith.

The learned AGP accepts notice for the added party. 3.

The Petitioner seeks conditional appointment. Reliance is placed on the judgment of the Division Bench of this Court in the case of Shrikant Chandrakant Saindane Vs. The State of Maharashtra & Ors. in Writ Petition No.2136 of 2011 (Aurangabad Bench) with connected Writ Petitions dated 25th August 2011. The said judgment would not enure to the benefit of the Petitioner inasmuch as the said judgment is with regard to the employment Basavraj 1/2

52.685.23-wp.docx under the State of Maharashtra and covered by the Government Resolutions issued by the State of Maharashtra. The said judgment is prior to the judgment in the case of Chairman and Managing Director, Food Corporation of India & Ors. Vs. Jagdish Balaram Bahira (2017) 8 SCC 670.

Dr. Sathe, the learned Senior Advocate relied on the judgment of the Division Bench of this Court in the case of Chitra Udaram Sonarghare Vs. State of Maharashtra & Ors. 2020 (3) Mh.L.J.

711. It is further submitted by the learned Senior Advocate for the Respondents that they have not yet called the wait listed candidates and the Petitioner may submit the validity.

Considering the above, we pass the following order: a.

The Petitioners shall appear before the concerned Scrutiny Committees on 18th April 2023.

b.

Considering the exigency, the Committees shall endeavour to decide the said proceedings preferably within four months from the date of appearance of the Petitioners. c.

The Petitioners may cooperate the Committees in expeditious disposal of the representation.

d.

With the aforesaid observations, the Writ Petition is disposed. No costs.
