This is an application for anticipatory bail in C.R. No.879 of 2020 registered with Andheri Police Station, Mumbai for offences under Sections 370(3) r/w Section 34 of Indian Penal Code and Sections 3, 4, 5, 7(1)(2) of the Immoral Traffic (Prevention) Act, 1956 (for short '

PITA Act').

Learned counsel of the applicant submits that in the charge-sheet filed against the co-accused, nothing is revealed against the applicant except some vague statements. All the victims are major.

Aher implicates the applicant stating that the applicant is conducting the alleged activities. However, during investigation it was revealed that Sajakali Jamadar

37-ABA-162-2021.doc Leave and License agreement in respect of concerned premises is in the name of co-accused. No material could be revealed to substantiate the statement of the co-accused. Charge-sheet has been filed against the arrested accused. Considering these circumstances, the applicant need not be subjected to custodial interrogation. Hence, I pass the following order :

ORDER

(i) Anticipatory Bail Application No. 162 of 2021 is allowed;

(ii) In the event of arrest of the applicant in connection with in C.R. No.879 of 2020 registered with Andheri Police Station, Mumbai the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) The applicant shall appear before the investigating officer as and when called for till filing of charge-sheet. (iv) Anticipatory Bail Application stands disposed of accordingly.
