1) Learned counsel for the applicant submits that during the pendency of this application, charge-sheet is filed and hence, he seeks liberty to withdraw the application with further liberty to approach the Sessions Court under section 439 of Code of Criminal Procedure, 1973 in the changed circumstances.

2) Liberty as prayed for is granted in the interest of justice. Learned Sessions Court shall not be influenced by the withdrawal of this application and shall consider the application on its own merits. Application stands dismissed as withdrawn.
