P.C.:- By this application the Applicant has sought to condone the delay in filing the appeal against the judgment and order dated 24/1/2007. As per the office note there is delay of 112 days in filing the appeal. Notice of the application is duly served on the Respondent Nos.1 and 3, who are the contesting parties. Despite service the Respondent Nos.1 and 3 have not remained present and have not contested the application.

Having heard the learned counsel for the Applicant and Megha 1/2

Megha 18_caf_377_2008.doc having perused the grounds set out in paragraph 2 of the application, which in my considered view constitute sufficient grounds, the application is allowed. The delay is condoned. 3.

The appeal be registered. Upon registration of the appeal notices be issued to the Respondent Nos.1 and 3, returnable on 16/7/2019.
