This is an application for seeking directions to registry to Arjun M.

Kadam by Arjun M.

Kadam Date: 2021.03.02 14:52:00 +0530 transfer the interest amount accumulated on the principal amount of Rs. 40,00,000/-. The applicant is the original complainant. The accused had preferred an application for Anticipatory Bail Application No.2389 of 2018 before the Sessions Court in connection with C.R. No.489 of 2018 registered with D.N. Nagar Police Station for offence punishable under Sections 498A, 420, 406, 504, 354, 323 read with Section 34 of the Indian Penal Code. The application was disposed of vide order dated 04th February, 2020. The original applicant/accused had deposited the

Ethape 2 49-IA-384-2021 amount of Rs.40,00,000/- in this Court in the aforesaid proceeding. The applicant/complainant sought leave to withdraw of Rs.40,00,000/- deposited by the accused in the registry of this Court. No objection was given at the instance of the accused to withdraw the said amount by the complainant.

It is submitted that the amount of Rs.40,00,000/- has been transferred from the registry to applicant's account on 09th October, 2020. However, the interest which was accrued on Rs.40,00,000/- has not been transferred into account of the applicant. It is further submitted that the amount of Rs.40,00,000/- deposited in the bank and there was no specific direction from the Court to return amount with interest. The applicant was directed to seek direction from this Court since the amount of Rs.40,00,000/- has been returned to the applicant. 3.

If, the said amount was deposited in the bank and interest was accrued thereon till the transfer of the same to the applicant, the same may be transferred to the account of the applicant. 4.

Interim Application is disposed of.
