Heard the learned Counsel appearing for the Petitioner and the learned APP for the State. Petition is filed seeking direction to the Respondent to add section 307 of IPC in the subject FIR, namely, CR.No.560 of 2016. Mr. Yagnik, the learned APP, on instructions submitted that investigation of the subject FIR is over and chargesheet is filed against the accused person for the offence punishable under section 326 of IPC. He also submitted that investigating officer of the subject crime will file report under section 173(8) of the Code of Criminal Procedure, 1973 to add section 307 of IPC in the subject crime after obtaining permission from the concerned Magistrate.
