This is an application for condonation of delay of 23 days in filing the appeal.

This appeal is listed today in view of the praecipe moved by the learned counsel appearing on behalf of the appellant on 6 February 2024 for urgent listing.

After hearing the matter for some time, the learned counsel for the parties jointly submit that this appeal can be disposed of by directing the learned trial Court to decide the pending motion within eight weeks from today.

In view of this, the learned trial Court is requested to dispose of pending notice of motion expeditiously and preferably within eight weeks from the receipt of this order. Till then, the parties to maintain the status-quo. It is clarified that this Court has not examined the merits of the matter and all the contentions of the parties are left open.
