Considering the limited grievance raised in the Petition, namely, the Petitioner who is the resident of village Kuruli, Tq. Khed, District Pune submitted an application to the Collector, Pune on 05th October, 2019 for lifting all the restrictions on allotment of the land or distribution of the land and then deletion of the land of the Petitioner from land acquisition process was expecting decision at a reasonable period, the Petition is taken up for final hearing and disposal at admission stage itself. The application dated 05th October, 2019, copy of which is placed on record at Exhibit A, page 10, is still pending before the Collector for decision. 2.

Considering this fact, without going into the merits of the matter, we deem it appropriate to dispose the Writ Petition with direction Umesh

14.WPST.1179.2020.doc to Respondent No. 2 - Collector (Resettlement), Pune to decide the application filed by the Petitioner dated 05th October, 2019, as early as possible and not later than 8 weeks from the receipt of order of this Court. If the Respondent No. 2 is of an opinion that to grant of opportunity of hearing to the Petitioner, he may afford such opportunity by giving reasonable time to the Petitioner.

We further reiterate that this Court has not made any observations on the merits of the Applications. Accordingly, Writ petition is disposed of with above referred directions.

All concerned shall act upon a copy of this order which is duly authenticated by the Registry of this Court.
