By this petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 01.12.2016 passed by Civil Judge, Junior Division, Daund below Exhibit-51 in Regular Civil Suit No. 173 of 2016 allowing Respondent original Defendant's Application under Order VI Rule 17 of the Code of Civil Procedure, 1908 for amendment in written statement.

Considering the submissions made by the learned counsel for the Petitioner and the reasons given by Trial Court, I am of the opinion that if decision in Regular Civil Suit No. 173 of 2016 goes against the Petitioner, he can raise ground in Appeal. Mohite 1/2
