This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 111 of 2022 registered at Shirur Police Station, Pune for the offences punishable under Sections 307, 326, 143, 147, 148, 149, 504, 506 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of incident which took place on 16 February 2022, the present applicant and other coKanchan P Dhuri 1 / 2

31-ABA-132-2023.odt accused assaulted the injured Sukhdeo Waghmode by iron rod, sticks etc. on account of some trivial disputes, which took place between them, one day prior to the incident.

I have perused the statement of the injured. The applicant at the time of alleged incident was not armed with any weapon. The alleged injury to the injured is not attributed to the present applicant. There are no criminal antecedents.

Considering the overall facts and circumstances of the case, I am inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicant - Khandu @ Khanderao Bhausaheb Shendge in Crime No. 111 of 2022 registered at Shirur Police Station, Pune for the offences punishable under Sections 307, 326, 143, 147, 148, 149, 504, 506 of Indian Penal Code, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount, subject to payment of Rs.20,000/- by the applicant to the injured towards medical expenses, within a period of three weeks from the date of uploading of order.
