Learned counsel appearing for the petitioner states that his client would file an appeal before the Education Officer of the Mumbai Mahanagar Palika, respondent no.4 to the petition within two weeks from today. Learned counsel appearing for the respondent nos. 1 to 3 states that his client would not raise any issue of maintainability of the appeal as well as issue of limitation before the appellate authority. The statement is accepted. 2.

In view of the statement made by the learned counsel appearing for the respondents, learned counsel for the petitioner does not press this petition. All other contentions on merits are kept open. Learned counsel appearing for the parties jointly state that they will co-operate with each other and with the Education Officer and would not take any unnecessary adjournments. Learned Education Officer shall make an endevour to dispose of the appeal if filed by the petitioner within one year from the date of filing of such appeal.

The Education Officer shall decide the matter in accordance with law and after hearing the parties.

In view of the aforesaid directions, the learned counsel appearing for the petitioner seeks liberty to withdraw this petition. Writ petition is dismissed as withdrawn. No order as to costs.
