Heard the learned Counsel for the applicant.

This is an application seeking condonation of delay in filing application seeking leave to file appeal, thereby challenging the Judgment and Order dated 15/9/2015 passed by Judicial Magistrate First Class, Thane in S.C.C. No. 1121 of 2012, thereby acquitting the respondent No. 2 of the offence punishable under Section 138 of the Negotiable Instruments Act. The delay is of 45 days. For the reasons assigned in paragraphs- 3 and 4 of the application, the delay of 45 days deserves to be condoned in the interest of justice. The Talwalkar 1/2
