Heard learned Counsel Mr. Desai for the appellant and Mr. Singh for respondent nos. 2,5, 7 to 9.

Both the Counsel agreed that it is not necessary to give any reason for disposal of present Appeal from Order.

By consent of both the parties, following order is passed:

a) The statement made by the Advocate for respondent nos. 2, 5 and 7 to 9 original plaintiffs that they will not execute the decree dated 15.12.2014 passed by the Trial Court in S.C. Suit No. 8826 of 1999 (High Court Suit No. 3397 of 1999) till hearing and final disposal of Misc. Application Sneha Chavan 1/2

b) In view of the statement made by the contesting respondents, the learned counsel for the appellant seeks liberty to withdraw the present Appeal from Order and pending Civil Application. Same is allowed.

c) Appeal from Order as well as Civil Application are disposed of as withdrawn.

d) Trial court is directed to decide Misc.

Application no. 5 of 2015 on next date or in any case, on or before 30.04.2015.
