This is an application for bail under Section 439 of the Code of Criminal Procedure.

The applicant was arrested on 12/4/2019 for the ofence punishable under Section 302 of the Indian Penal Code. The allegation is that he has killed his wife with a blow of hammer on her head. The applicant himself went to the police station and surrendered. The applicant reported that he has murdered his wife and on the basis of the report the crime is registered. 3.

Learned counsel for the applicant contended that the applicant has two minor children who have to be looked after and he is in custody since 12/4/2019. He submitted that the applicant

35. BA 225-20.doc had no intention to kill his wife and therefore the case does not fall under Section 302 of the Indian Penal Code.

Considering the gravity of the allegations and the materials on record, this is not a ft case to grant bail. I have gone through the order passed by the Additional Sessions Judge and the relevant documents pertaining to the investigation. I see no reason to entertain this application.
