Having heard Mr. Chagla, learned Senior Counsel appearing for the petitioners and Mr. Jetly appearing for the contesting respondent Nos.1 & 3, we grant leave to amend in terms of the draft annexed to the Civil Application. The amendments be carried out within a period of one week from the date of receipt of copy of this order. In the light of the affidavit filed by Mr. Rakesh Kumar working as Deputy Director General of Deshmane, (P.S.) 1 of 2

prod.1.CAW.131-15-CIVIL.doc Foreign Trade, Ministry of Commerce & Industry, Department of Commerce, Government of India on 20th January, 2015 and in the light of the statements contained therein, Mr. Chagla learned Senior Counsel does not press for any ad-interim relief. 3.

Liberty to apply for interim relief after the amendments are carried out.

We clarify that the amendment is without prejudice to the rights and contentions of both sides including on the point of maintainability of the Writ Petition.

Civil Application is disposed of.
