Civil Application No. 1294 of 2017 is filed for condonation of delay of 105 days in preferring the appeal. Issue notice to the respondents, returnable on 07.11.2017. In addition, private service is allowed.

By this Civil Application, the applicant/insurance Company seeks stay to the operation and execution of the impugned judgment and award dated 21.07.2016 passed by the learned Commissioner of
Trupti 909-fast-1381-17.doc Employee's Compensation and Judge Sixth Labour Court, Mumbai, in Application (WCA) No. 457/B-88/2012.

Learned counsel for the applicant submits that the applicantInsurance Company has deposited an amount of Rs. 9,45,790/- which includes the principal amount of compensation i.e. Rs. 4,42,740/- plus interest of Rs. 5,03,050/- by cheque dated 10.02.2017. 4.
In view of the above submission, the operation and execution of the impugned judgment and award dated 21.07.2016 passed by the learned Commissioner of Employee's Compensation and Judge Sixth Labour Court, Mumbai, in Application (WCA) No. 457/B-88/2012 is stayed till the final decision of the appeal. 5.
Civil Application stands disposed of accordingly. (MRIDULA BHATKAR, J.)
