1.ba26.17.sxw Learned Sr. Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to approach the Court of Metropolitan Magistrate, 47th Court, Esplanade, Mumbai seeking same relief of grant of temporary bail as the learned APP has pointed out that the applicant had not approached the trial court on the said ground.
In view of this, application stands dismissed as withdrawn. However, the learned Magistrate is requested to consider the application on its own merits without being influenced by the withdrawal of this application. The application stands dismissed as withdrawn and disposed of accordingly.
