The Writ Jurisdiction of this Court is invoked against the order dated 1-1-2015 passed by the Learned 5th Joint Civil Judge Senior Division, Thane, by which order the application Exhibit 99 filed by the Defendant i.e. the Petitioner herein, came to be rejected.

Having regard to the reasons mentioned in the impugned order and more specially the fact that the Suit is set down for final arguments, the instant application Exhibit 99 came to be filed. Hence no fault can be found with the impugned order. The Writ Petition is accordingly dismissed. Needless to state that the Suit would be tried on its own merits and in accordance with law, uninfluenced by the impugned order. [R.M.SAVANT, J] mmj
