These are applications under Section 438 of Cr.P.C. by the applicants / accused in Crime No.I-114/2017 for offence under Section 326, 324, 504, 506 read with Section 34 of Indian Penal Code Vina k 1/2

sr.2.aba.103 & 105 of 2018 registered with Police Station Nava Sheva, Navi Mumbai at the instance of Jayesh Jagannath Tandel.

When the applications are taken out for hearing, the learned Additional Public Prosecutor on instructions of Investigating Officer Mr.Sanjay L. Suryawanshi, API, Nhavasheva Police Station, Navi Mumbai, submits that now it is transpired that the victims have not suffered grievous hurt, and therefore, the chargesheet is being filed for the offence punishable under Section 324 of the Indian Penal Code. 3.

In view of the statement made by the learned Additional Public Prosecutor, the learned Advocate appearing for the applicants submits that he is not pressing the instant application as the offence under Section 324 of the Indian Penal Code is bailable one. 4.
