The applicants have approached the High Court directly under Section 438 of Cr.P.C. without approaching the Sessions Court. Although there is concurrent jurisdiction, judicial discipline warrants that the applicants shall approach the Sessions Court at the first instance. 2.

The learned counsel for the applicants submits that he would withdraw the Application in order to approach the Sessions Court. The Application stands dismissed as withdrawn.
