The learned counsel for the appellant and respondents submitted that in this Appeal from Order, the appellant/original plaintiff is challenging the order dated 22nd December, 2016 passed by the learned Judge of the City Civil Court thereby refusing the adinterim relief in Notice of Motion No. 3751 of 2016 in L.C. Suit No. 134 of 2011.

The ad-interim order was passed on 22nd December, 2016 and I am informed that the Notice of Motion is not yet heard finally. Considering the gap of 8 months, the trial Court is hereby directed to 1 / 2
506.AO376_2017.doc hear the Notice of Motion finally till 10th October, 2017. The respondents may file affidavit-in-reply to the Notice of Motion before the trial Court, if any, within two weeks from today. 4.
With this, Appeal from Order is disposed of. Civil Application is also accordingly disposed of.
