Heard Mr. Dabake, the learned AGP for the State/appellant and Ms. Dhivar, the learned Counsel for respondent no.1.

Mr. Dabake, the learned AGP, on instructions, in writing, submits that the appellant does not wish to further prosecute the appeal as the appellant has given rate of Rs.12/- per Square Meter for the acquisition of the subject land, which falls within the jurisdiction of village Dive.

Mr. Dabake has tendered the pursis.

The pursis is signed by Mr. Ramesh Thawal, Nayab Tahsildar, Land Acquisition, Metro Center-3, Thane, and Mr. Bhaskar Naik, respondent no.1. Mr. Ramesh Thawal and Bhaskar Naik - respondent no.1 are present in Court and admit the terms of the aforesaid pursis. The pursis also bears the signatures of the learned Counsels for the parties. The statements made in the pursis and the accompanying documents are accepted as the undertakings to the Court. 5.

In view of the aforesaid pursis, the appeal stands disposed of as withdrawn.

Court fee be refunded as per Rules.

In view of the withdrawal of the appeal, the Civil Application No.382/2002, does not survive and stands disposed of.
