By this writ petition under Article 227 of the Constitution of India, petitioner/original defendant is challenging the order dated 02.01.2012 passed by the learned District Judge, Sangli in Miscellaneous Civil Appeal No.62 of 2010 arising out of the judgment and order below Exhibit-5 in Regular Civil Suit No.41 of 2009.

The learned Counsel for the petitioner submits that during the pendency of the present writ petition, learned Civil Judge, Junior Division, Miraj decided Regular Civil Suit No.41 of S.C.Magar

38-wp-1430-2012.doc 2009 on its own merits by judgment and decree dated 06.10.2016. He placed on record the copy of the said judgment. Same is taken on record and marked 'X' for identification. He submits that in view of subsequent development nothing survives in the present writ petition.

Hence, writ petition stands disposed of as infructuous. 5.

No order as to costs.
