By this civil application, the applicant seeks transfer of Hindu Marriage Petition No.996 of 2014 filed before the learned Civil Judge, Senior Division, Kalyan, Dist. Thane to the learned Civil Judge, Senior Division, Kolhapur, Dist.Kolhapur.

Learned counsel from the respondent on instruction from his client who is present in court states that his client has no objection if the relief claimed in prayer clause (a) of the miscellaneous civil application is granted. He submits that the learned Civil Judge, Senior Division, Kolhapur, Dist.Kolhapur has jurisdiction to decide the Hindu Marriage Petition No.996 of 2014 upon transfer. The statement is accepted.

In view of the statement made by the learned counsel for the respondent, Misc.Civil Application No.47 of 2015 is allowed in terms of prayer clause (a).

The learned Civil Judge, Senior Division, Kalyan, Dist. Thane is directed to transmit the papers and proceedings of Hindu Marriage Petition No.996 of 2014 to the court of learned Civil Judge, Senior Division, Kolhapur, Dist.Kolhapur expeditiously.

The parties are directed to appear before the learned Civil Judge, Senior Division, Dist.Kolhapur on 24th October, 2016. 6.

The parties as well as the learned Civil Judge, Senior Division, Kalyan, Dist. Thane to act on the authenticated copy of this order. 7.

Misc.Civil application is disposed of in the aforesaid terms. No order as to costs.
