This is an Application filed under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending her arrest in C.R.No.278/2022 registered with DCB, CID, Unit - 7, Mumbai for offences punishable under sections 420, 465, 467, 468, 471, 506, 120-B r/w. 34 of the Indian Penal Code.

Order dated 02/03/2023 reveals that the Applicant and the first informant had tendered the deed of settlement/consent terms. As per the consent terms, the Applicant had paid to the first informant an amount of Rs.58,50,000/- and the second installment was payable on 15/04/2023.

Learned counsel for the Applicant and Intervenor states that the Applicant has paid the said amount and thus complied with the consent terms.

Since the dispute between the parties is settled amicably, the Application is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.278/2022 registered with DCB, CID, Unit - 7, Mumbai, she shall be released on bail on furnishing bail bonds in the sum of Rs.25,000/- with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer ; 2/3

(c) The Applicant shall not interfere with the complainant and the other witnesses and shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case in any manner ;

(d) The Applicant shall keep the Investigating Officer informed of her current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.
