This application is for restoration of Writ Petition No. 3539 of 2002, which was dismissed for default by order dated 05/01/2017.

Considering the submission made by learned A.G.P. Mrs. Nimbalkar, for the applicants and averments made in civil application, I satisfy that the applicants have made out case for allowing this civil application. Hence following order : Order 1.

Order dated 05/01/2017 passed by this Court is recalled. 2.

Writ Petition No. 3539 of 2002 is restored on file for hearing on its own merits.

The learned counsel Mrs. Desai, for the respondent, waives service in Writ Petition No. 3539 of 2002.
