The applicant has been convicted by the learned Addl. Chief Metropolitan Magistrate 47th Court, Esplanade, Mumbai, for the offence punishable under Section 379 of the Indian Penal Code and has been ordered to undergo R.I. for one year and to pay a fine of Rs.2,000/- (Rupees Two Thousand), in default to further suffer S.I. for one month. He filed Appeal before the Sessions Court, Greater Bombay. Said Appeal has been dismissed by order dated 29th December, 2014. The Revision Application filed by the applicant has been admitted by this Court and is listed for final hearing on 24th February, 2015.

ba-25-15 Considering the nature of offence and the punishment, I am inclined to grant bail to the applicant. The applicant be released on bail in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one solvent surety in the like amount or cash deposit of Rs.15,000/- (Rupees Fifteen Thousand) in lieu of surety of Rs.15,000/- (Rupees Fifteen Thousand). The substantive sentence imposed on the applicant shall remain suspended during the pendency of the Revision Application. This application stands disposed of accordingly. ( JUDGE ) 2/2
