This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 139 of 2021 registered at Shikrapur Police Station, Pune for the offences punishable under Sections 420, 409, 465, 467, 468, 471, 120-B of Indian Penal Code.

According to the prosecution, the present applicant and other co-accused in connivance with each other defrauded the Shivajirao Bhosale Sahakari Bank to the tune of Rs.2.10 crore.

The applicant has filed Affidavit-cum-undertaking. For ease of reference, the said Affidavit-cum-undertaking is scanned and reproduced hereunder :

The learned Counsel for the applicant on instructions submits that the applicant has already deposited an amount of Rs.25 lakhs with the liquidator - Shivajirao Bhosale Co-operative Bank. 6.

Considering the overall facts and circumstances of the case and in view of the Affidavit-cum-undertaking filed by the applicant, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicant - Sanjay Mahadev Jagtap in Crime No. 139 of 2021 registered at Shikrapur Police Station, Pune for the offences punishable under Sections 420, 409, 465, 467, 468, 471, 120B of Indian Penal Code, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii) The prosecution is at liberty to file application for cancellation of anticipatory bail in case the applicant commits breach of undertaking. ( N.R. BORKAR, J. ) 5 / 5
