Heard learned counsel for the applicant and the learned APP for the State. Investigating Ofcer is present.
Applicant is seeking his release on bail in connection with Crime No.42 of 2019 registered with RAK Marg Police Station for the ofences punishable under Sections 302, 323, 504, 141, 143, 147, 148, 149 Shivgan 1/3
and 120B of the Indian Penal Code, 1860.
Co-accused Shaun Wilson Vera has been released on bail by this in Bail Application No.2869 of 2019. Role attributed to the applicant is similar to the role that was attributed to Shaun Wilson Vera. The learned APP has drawn my attention to the CC TV footage panchanama, which shows, applicant had arrived at the spot of the incident on motor-cycle with two pillion riders. One of them was accused no.8, who has been released on bail by this Court. Though it is alleged that the co-accused had handed over the weapon to accused no.6, who in turn had thrown away weapon.
In view of the evidence on record as against the applicant, which is similar in nature against the coaccused, who has been released on bail by this Court, application is allowed. Hence, the following order:
ORDER
(i) The applicant be enlarged on bail in Crime No.42 of 2019 Shivgan 2/3
registered with RAK Marg Police Station, on executing PR Bond in the sum of Rs. 25,000/- with one solvent surety in the like amount;
(ii) The applicant shall attend the concerned Police Station on the second Monday of every month between 10:00 a.m. to 11:00 a.m,till the framing of charge;
(iii) The applicant shall not reside within the jurisdiction of RAK Marg Police Station for a period of six months from the date of his release on bail;
(iii) The applicant shall furnish his residential address as well as permanent residence and mobile number to the Investigating Ofcer within seven days from his release on bail;
(iv) The applicant shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case;
The application is allowed and disposed of.
It is made clear that observations made hereinabove be construed as expression of opinion only for the purpose of grant of bail and the same shall not in any way infuence the trial in other proceedings.
