The learned counsel for the petitioner, in view of the Judgment of the Division Bench of the Delhi High Court reported in (2017) 205 Comp Cas 643 in the matter of M/s. ATV Projects (India) Limited Vs. Union of India and others, seeks withdrawal of the Petition to seek appropriate recourse before the NCLT.

2 902.2682.17 wp.doc The Writ Petition is accordingly allowed to be withdrawn and dismissed as such. If any proceedings are filed before NCLT by the petitioner, the fact that the petitioner was prosecuting the above Writ Petition in this Court from 13/01/2017, may be considered by the NCLT.
