Heard Mr. Badgujar, learned Counsel for the petitioner. 3.

This matter is moved by way of praecipie dated 28th September, 2018 for withdrawal of the Petition. Mr. Badgujar submitted that the petitioner, who has instituted Marriage Petition No. 171 of 2002 in the trial Court desires to withdraw that Petition. However, in view of the interim order operating in the above Petition, the petitioner is unable to withdraw the Marriage Petition. He, therefore, seeks permission to withdraw the Petition so as to enable him to withdraw the Marriage Petition pending in the trial Court. Along with Praecipie, he has enclosed written instructions dated 25th September, 2018 given by the mother of the petitioner instructing Mr. Kulkarni to withdraw the Petition. Praecipie along with medical certificate issued by Navjeevan Hospital, Kolhapur and the written instructions is taken on record and marked 'A' colly for identification.
