This is an application under Section 439 of Cr.P.C. filed by the aforesaid Applicant, who has been arrested in C.R. No.303 of 2021 for the offences punishable under Sections 376(3) and 376(F) of the IPC and under Sections 4, 6, 8, 10 and 12 of the Protection of Children from Sexual Offences, Act, 2012.

The Applicant herein is alleged to have committed rape on a 13 year old child, who is the daughter of his cousin. The matter was heard on merits and when this Court was not inclined to grant bail, learned counsel for the Applicant seeks leave to withdraw the 1/2
