The appeal is instituted by Shriram General Insurance Co. Ltd. being aggrieved by judgment and award dated 31/08/2017 passed in MACT Application No.38 of 2014 at the hands of the MACT at Kolhapur.

Learned counsel for the appellant states that he is desirous AJN

2/2 06 FA-515.18.odt of withdrawing the appeal and the reasons cited is to the effect that the appellant has worked out a settlement with the claimants and the amount of compensation agreeable to the claimants is received by them.

In such contingency, though the appeal was instituted in the year 2018, since there is no stay operating, accepting the statement made on behalf of the appellant that the claim of the claimants have been satisfied, the appeal is permitted to be withdrawn and is disposed of as such.

In the wake of the disposal of the appeal, the amount of pre deposit of Rs.25,000/- along with interest shall be transferred to MACT, Kolhapur and the appellant is permitted to withdraw the same. The appellant will also be eligible for the refund of court fees, as per rules.
