The learned Counsel for Petitioner, on basis of instructions from the Petitioner, states that he does not press this matter and seeks leave to withdraw the same. Accordingly, leave is granted and the petition is disposed of as withdrawn.

The learned Counsel for Petitioner, similarly on the instructions from the Petitioner, states that Appeal No.189 of 1990 in Injunction Notice No.2830 of 1989 pending before the Appellate Bench of the Small Causes Court may also be permitted to be withdrawn. Accordingly, leave is granted for the said purpose as well and Appeal No.189 of 1990 is dismissed as withdrawn. URS

It is further made clear that the withdrawal of this petition and the appeal is without prejudice to the rights and contentions of both the parties pending R.A.D. Suit No.2539 of 1989. Accordingly, this petition, as also Civil Application Nos.174 of 1993, 1597 of 1994 and 6614 of 1996 pending herein (if any) stand disposed of. (M. S. SONAK, J.) URS
