By this Civil Application, the applicant seeks orders for modification of the order dated 8.7.2015. The learned Counsel for the applicant points out the letter dated 8.10.2015 issued by the office of the Court Receiver, High Court, Bombay. The representative of the original appellant is present in Court. He is the son of the appellant. He submits that the appellant has no objection to the modification of the order. 2.

Pursuant to the order dated 8.7.2015 passed by this Court, the following order is passed:

caf.355.2016_28.doc i) The Court Receiver is discharged without passing accounts; ii) The Court Receiver, High Court, Bombay, is directed to forthwith hand over the possession of the suit flat No.4/B, 4th floor Girnar Apartments, Pali Hill road, Bandra (West), Mumbai, to the applicant/defendant.
