ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION NO. 778 OF 2015 Amba Ravji Patel & Anr.
.. Petitioners Vs.
Deputy Registrar, Co-Operative Societies & Ors. .. Respondents Mr. Bharat Joshi for the Petitioners.
Mr. S.D. Rayrikar, A.G.P. For Respondent Nos.1, 4 & 5. Mr. S.I. Menon for Respondent Nos.2 & 3.
CORAM : ANOOP V. MOHTA, J.
DATED : 24 FEBRUARY, 2015 P.C.
Heard finally by consent of the parties.
I am inclined to dispose of the present Writ Petition, as the statement is made by the learned A.G.P. appearing for the Respondent No.5 that the concerned Revisional Authority has fixed the Revision, filed under section 154 of M.C.S. Act, for hearing along with the Stay Application on 3rd March 2015, therefore, there is no point in keeping this Petition pending here. It is accordingly, disposed of. All points are kept open. However, interim order granted on 22.1.2015 to continue till 3rd March 2015 and if for some reasons, hearing could not take place, it will be continued for the first date of hearing along with the
wsw 44.wp.778.15.doc stay Application. The concerned Authority to pass order, in accordance with law, after hearing both the parties. However it is made clear that the interim order of status quo, granted by this Court, will continue till the Revisional Authority decided the stay application on its own merit, uninfluenced by this order filed by the Petitioner. The Writ Petition is disposed of accordingly, with liberty. All points kept open. No costs.
