Applicant is seeking regular bail in Crime No. 281/2018 registered with Saswad Police Station, Pune for offence punishable under sections 302, 307, 143, 145, 147, 148, 149 of the Indian Penal Code and Section 3 (25) of the Arms Act. The role attributed to the applicant, pursuant to the supplementary statement dated 03/08/2018 is that of throwing chili powder on the complainant.

So far as the statement of eye witnesses recorded under section 164 of Code of Criminal Procedure, 1973 are concerned, no specific role is attributed to the applicant of throwing chili powder, rather the said role is attributed to some other co-accused. That being so, application for bail is made out. Hence, following order: (A) Applicant be released in Crime No. 281/2018 registered with Saswad Police Station, Pune on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(B) Applicant shall not influence witnesses or tamper with evidence.

(C) Applicant shall co-operate with the investigating agency.

Application stands disposed of.
