The applicant is seeking quashing of FIR/CR No. 05 of 2018 of Versova Police Station, Mumbai and the proceedings relating thereto. The case is under sections 354D, 324, 504, 506 of IPC.

Heard learned Counsel for the applicant - original accused, learned Counsel for the respondent No. 2 - original 1/3
complainant and learned APP for the State.

The applicant - accused is present before the Court. The complainant is also present before the Court. The complainant stated that the matter has been amicably settled between her and the applicant and hence, she does not wish to pursue her complaint. She has tendered affidavit which is taken on record and marked 'X' for identification. In the said affidavit it is stated that FIR was lodged by her out of anger and rage and on account of misunderstanding between her and applicant. The dispute has been resolved and they both have amicably settled the matter. She states that in view of the amicable settlement between her and the applicant, she does not wish to proceed with her complaint.

Looking to the fact that the matter is amicably settled between the parties and looking to the fact that the complainant does not wish to pursue the case, we are of the opinion that no purpose would be achieved by continuing with 2/3
the prosecution in the said matter.

In view of the above, FIR/CR No. 05 of 2018 registered with Versova Police Station, Mumbai and the proceedings relating thereto are quashed.
