Heard Mrs.Anjali Patil, learned counsel for the applicant.

The previous application filed by the applicant was withdrawn by him. (Criminal Application No.169/14) (decided on th June 2014). At that time, the trial Court was asked to expedite the trial and endeavour to complete it within a period of nine months from the date of the said order.

The learned counsel for the applicant submits that the trial is still not over. She further submits that certain relevant evidence has been recorded in the matter, and that after the evidence has been recorded, the case of the applicant for release on bail has become stronger. She intends to apply afresh for bail

Tilak 2/2 (5)BA-119-16 in the trial Court in view of the developments, and seeks permission of this Court to withdraw the present application. Application is allowed to be withdrawn and stands dismissed, as such with liberty to the applicant to apply afresh for bail before the trial Court.

In the event of such an application being made, the trial Court shall decide the same on merits and in accordance with law without being influenced in any manner by the withdrawal of the present application by the applicant.

Application is disposed of accordingly.
