After arguing the petition for quite some time, Mr. Sawant seeks liberty to withdraw Suit No.167/2017 (S.C. Suit (st.) No.11577/2016) with liberty to file fresh suit on the same cause of action. In view thereof, on the motion made by Mr.Sawant, the plaintiff is allowed to withdraw the suit with liberty to file fresh suit on the same cause of action. The petitioner shall produce authenticated copy of this order before the trial Court for passing necessary
