By this Civil Application, applicants are seeking condonation of 1 year and 126 days delay in filing First Appeal challenging Judgment and Award dated 25/05/2017 passed by learned Civil Judge, Senior Division, Alibag, Raigad in Land 1/2

54. caf 874.19.doc Acquisition Reference No. 505 of 2016 holding that the respondents - claimants are entitled additional compensation of Rs.16,11,362/- in respect of acquired land.

Considering the submissions made by learned AGP for the applicants and averments made in Civil Application, I am satisfied that applicants have made out a case for allowing Civil Application. Hence following order.

O R D E R

i) Civil Application is allowed in terms of prayer clause (b) which reads thus :

"(b) this Hon'ble Court be pleased to condone the delay of 1 years and 126 days in filing the above mentioned First Appeal against the Judgment and Award dated 25.05.2017 passed by the Learned Civil Judge, Senior Division, Alibag, Raigad in L.A.R. No. 505 of 2016. "

ii) Civil Application is disposed of accordingly. iii) No order as to costs.
