This is an application for bail. The ofence is under Section 302 of the Indian Penal Code. It is alleged that the applicant assaulted his wife on her head with an axe on 21/5/2015. The victim Anusayabai succumbed to the injuries.

Learned APP pointed out on instructions that the trial has commenced and even the evidence close pursis has been fled on 27/7/2021. The matter is listed before the trial Court for recording statement under Section 313 of the Code of Criminal Procedure. In this view of the matter, I see no reason to entertain 1/2
