The main Writ Petition was dismissed as affidavit of service of private notice was not filed on or before 7th December, 2016. It is contended on the basis of Exhibit- B to the application that affidavit was filed on 8th December, 2016.

In view of the statements made in the application, a case for restoration is made out. Accordingly, application is allowed in terms of prayer clause (b).
