Heard the learned counsel for the applicant and the learned APP.

This is an application seeking modification of the order dated 8th May, 2014 passed by the Coordinate Bench (Coram : A.R. Joshi, J) in Criminal Bail Application No. 568 of 2014. While granting bail the Hon'ble Court had directed the applicant to attend the concerned Talwalkar 1/2

17.appp59.15.sxw investigating agency on every Monday between 10 a.m. to 12.00 noon till the conclusion of the trial.

The learned APP submits that the order need not be modified as the Court had considered the merits of the case and has passed an appropriate order. As against this, the learned Counsel for the applicant submits that the case is committed to the Court of Sessions and the applicant is giving an undertaking that he would attend each and every date before the trial Court.

In view of this, the order dated 8th May, 2014 needs to be modified. The applicant shall attend the concerned police station as and when called. Since the learned APP upon instructions has failed to give any reason for not modifying the order, the application is allowed in the above terms and is disposed of accordingly. (SMT. SADHANA S.
