The Consent Terms are accordingly taken on record and marked 'X' for identification. The undertakings made in clauses 6, 12 and 21 are accepted. The Consent Terms are signed by the respective parties and also by their learned Advocates. There is no dispute on the signatures of the parties.

The learned Counsel for the parties state that though the Consent Terms are signed by Respondent No. 8 on page 13, the same are not signed by Respondent No. 8 from pages 1 to 12, as Respondent No. 8 was not available. It is however stated that this position is acceptable to the parties.

First Appeal No. 138 of 2009 is accordingly disposed of in terms of the Consent Terms. No costs.
