The Applicant was convicted for offence punishable under Section 138 of the N.I. Act and sentenced to suffer imprisonment for one year and pay a fine amount of Rs. 2,00,000/-. The appeal preferred by him against conviction has been dismissed. He is, therefore, in revision before this Court.

The Applicant has been arrested. He is in jail since 12 January. Learned Advocate for the Applicant makes a statement that the amount directed to be paid as compensation/fine would be paid in its entirety within a period of eight weeks. Once the Applicant comes out of jail, he is also ready to deposit a sum of Rs.40,000/- within three days.

In view of the above, substantive sentence of imprisonment to stand suspended, pending the revision application. 5.

The Applicant be released on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) and Surety Bond in the like amount. If the Applicant fails to deposit sum of Rs.2,00,000/- within two months from the date of this order in trial court, bail granted to him is liable to be cancelled.

The Applicant to deposit a sum of Rs.40,000/- in the trial court within a period of four days from the date of this order and the balance amount within next seven weeks.

The Applicant be released on P.R. Bond immediately. One week's time is granted to furnish Surety Bond. Bail before the trial court.

Application for suspension of sentence (Interim Application No.210 of 2023) and application for bail ((Interim Application No.209 of 2023) stand disposed of. 9.

Issue notice to the Respondents in Criminal Revision Application No.25 of 2023 returnable on 15 February 2023. (R.G. AVACHAT, J.)
