Learned counsel appearing for the appellant states that the parties have already settled the disputes before the M.A.C.T. Mumbai in Execution Application No.177 of 2018 on 2nd December, 2019 and in view of the said settlement arrived at between the parties, learned counsel seeks liberty to withdraw this appeal. A copy of such order is taken on record.

The first appeal is dismissed as withdrawn. Refund of Court fees, if any, as per Rules.

The appellant would be at liberty to withdraw the statutory deposit of Rs.25,000/- deposited in this Court in view of the appellant 1/2
